Liability Limitations and Dispute Resolution

Your use of the Coyote Currents Platform is at your sole risk. The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. Coyote Currents makes no warranty that the Platform will meet your requirements, be available on an uninterrupted, secure, or error-free basis, or that defects will be corrected. We will endeavor to schedule maintenance, but service may be temporarily unavailable without notice.

To the maximum extent permitted by applicable law, Coyote Currents, its affiliates, directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Platform; (ii) any conduct or content of any third party on the Platform; (iii) any content obtained from the Platform; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

In the event of any concern or dispute about the Platform, you agree to first try to resolve the dispute informally by contacting Coyote Currents. If a dispute arises and cannot be resolved informally, you and Coyote Currents agree to resolve any claim or controversy arising out of or relating to these Terms or the breach thereof through mediation, followed by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

You agree to indemnify and hold Coyote Currents harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your use of the Platform. Coyote Currents reserves the right to terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Platform will immediately cease.
